VCF Proof of Presence in the NYC Crash Site “Exposure Zone”

According to the Victim Compensation Fund (VCF) Claim Form Document Checklist, you must submit at least two forms of written proof for your 9/11 Fund registration to prove that you or a family member was present at the NYC crash site “Exposure Zone” between September 11, 2001 and May 30, 2002.

In most cases, in addition to the documentary proof set forth below, the VCF also requires that you submit properly prepared and detailed “Proof of Presence” affidavits along with the above documentation.

You can consult with our 9/11 attorneys regarding the proper documents to acquire for adequate VCF Proof of Presence. Be advised that insufficient or not properly presented proof will result in the delay of your claim and, in many cases, the denial of your claim.

Examples of types of documents which can be used to show VCF Proof of Presence include:

Employer Records

This could include a letter from your employer confirming work at the site, an official personnel roster and site credentials confirming work at the site, workers’ injury reports documenting injury at the site, or a pay stub showing dates of work and location at the site.

Proof of Residence

You could prove you were living in the area during the relevant time period through rent or mortgage receipts, utility bills, and proof you were physically present at the site, or a sworn statement from a witness who can attest to your presence at the residence.

Contemporaneous Documents

Documents that show locations you were stationed at near the site can include orders, instructions, confirmations of tasks performed, medical records that show treatment as a result of injury that occurred at the site, or school or day care records confirming enrollment or attendance during the relevant time period.

Sworn and Notarized Affidavits

If you receive affidavits regarding presence from persons who can attest to you or your loved one’s presence at the 9/11 crash site or unsworn statements complying with 28 U.S.C. 1746, this is adequate proof of presence.

You DO NOT Need to Submit Proof of Presence if:

You were an active firefighter working for the FDNY on September 11, 2001.

The VCF will obtain verification of presence directly from the FDNY. You do not need to submit any documentation for proof of presence. 

You received an award through the original September 11th Victim Compensation Fund (2001-2004).
