They returned to live and work to get back a sense of normalcy and, importantly, because the EPA and city officials encouraged everyone to get back to “normal” declaring the air was safe to breathe. It was not.

More than 2,500 contaminants and cancer-causing toxins circulated through the air in the months after the attack, including asbestos, fiberglass, and concrete dust. These toxins coated city buildings, coated the air condition ducts and deep inside the building, in the alleyways and fire escapes, and even found their way into the drinking water.

Now years after breathing these toxins, first responders and downtown survivors suffer from a variety of medical conditions, such as over 70 different types of cancers, COPD, asthma, chronic disabling lung conditions, and other debilitating breathing and digestive medical issues.

Under the James Zadroga 9/11 Health and Compensation Act, which President Obama signed into law on January 2, 2011, the victims of the 9/11 attacks, including those who responded to the scene after the accident, have the right to seek compensation through a reactivated Victim Compensation Fund.

On July 29, 2019, President Trump signed into law The Never Forget the Heroes: James Zadroga, Ray Pfeifer, and Luis Alvarez Permanent Authorization of the September 11th Victim Compensation Fund. This extended the VCF’s filing claim deadline to October 1, 2090, and ensured that the fund can appropriate whatever money is necessary to pay all approved claims.

The Zadroga Act created two different programs for victims who were injured on 9/11 or in the months that followed because of their presence in the Exposure Zone.

The World Trade Center Health Program (WTCHP)

This program provides lifetime healthcare for all certified 9/11-related conditions to a variety of 9/11 victims and survivors who were present in the Lower Manhattan Exposure Zone between 9/11/01 and 7/31/2002, including:

  • First responders, including police, firefighters, and construction workers
  • Volunteers who stepped up to aid in recovery
  • Cleanup crews
  • 9/11 survivors, including downtown workers, residents, and students

To gain eligibility for the WTCHP benefits, you must establish Proof of Presence in the Exposure Zone which includes Lower Manhattan up to Houston Street, as well as Brooklyn Heights.

The September 11th Victim Compensation Fund (VCF)

The VCF makes awards of compensation to first responders and survivors, including downtown Manhattan residents, area workers, and students in the area. To obtain compensation through this program, you must have a certified WTCHP medical condition and show Proof of Presence in the Exposure Zone.

The VCF Exposure Zone is smaller than the WTCHP Exposure Zone and only consists of Lower Manhattan south of Canal Street/East Broadway/Clinton Street. You must show your presence in this area between 9/11/2001 and 5/30/2002.

This VCF offers compensation to eligible victims and includes compensation for out-of-pocket medical expenses that exceed $5,000, lost wages due to 9/11-related illness and injury, and non-economic losses, often called pain and suffering, which helps provide vital compensation for the losses the victim faces as a result of cancer and other illnesses.

The VCF often awards a considerable amount of “pain and suffering” to first responders and survivors. However, the amount you receive is dependent on your ability to provide proof and show the devastation and impact of 9/11 on your life and your health. Determining Eligibility

The process to determine eligibility for 9/11-related illness compensation can prove complex. To qualify for assistance from either the WTCHP or the VCF, you must first prove that you have an illness — such as cancer or breathing or digestive illness — that is related to environmental exposure on or during the months after 9/11.

Qualifying factors include:

  • Presence in affected areas during the covered times. You will need to show that you spent time in the New York City Exposure Zone during those covered periods for a minimum number of hours or days on or after 9/11.
  • Diagnosis of an illness on the list of “covered conditions.” Only victims with those specific conditions can receive funds from either the VCF or the WTCHP, which work together to determine eligibility and compensation. Covered conditions include asthma, chronic cough syndrome, GERD, reactive airways dysfunction syndrome, sleep apnea, upper airway hyperreactivity, COPD, and a list of over 70 cancers, including prostate cancer, breast cancer, and one of the various blood cancers such as non-Hodgkin lymphoma, Hodgkin’s disease, leukemia, multiple myeloma, and digestive system issues. Most times, you will need to undergo an evaluation by the WTCHP’s physician to determine eligibility for covered illnesses. Unlike other types of personal injury claims, the VCF only offers compensation for physical injuries and illnesses, which means you cannot claim suffering due to PTSD or other emotional trauma related to the 9/11 attacks. The WTCHP, however, will provide free lifetime counseling and therapy for PTSD or other mental health conditions.

How Much Compensation Do You Deserve for 9/11-Related Illnesses?

If you suffered serious illness due to exposure to debris, fumes, or dust after the 9/11 attacks, the VCF helps you seek the compensation you deserve for those challenges. While the fund cannot prevent you from suffering serious illnesses, including respiratory disorders and some cancers, due to that exposure, it can provide valuable compensation that can help you rebuild your life or manage the financial challenges associated with those illnesses.

Past Medical Expenses

Medical expenses related to serious illness can mount quickly, especially if you suffer from conditions like COPD, cancer, or mesothelioma. You can count the cost of hospitalization, including long-term hospitalization needed during treatment for serious illness, radiation, chemotherapy, surgery, and therapy related to your recovery.

The VCF does have a minimum claim amount of $5,000, which means that you cannot file a claim for reimbursements of your medical expenses for compensation until after they exceed that amount. There is, however, no maximum amount or cap on VCF awards of past medical expenses.

Many victims, especially those that suffer a long-term illness, may struggle to return to work. Serious lung conditions, for example, may prevent you from working in an environment that exposes you to a great deal of dust and debris. Cancer treatments can rob you of energy and make it difficult for you to take on any job duties at all.

The VCF provides compensation for the wages (and any benefits such as a reduced pension) you lost as a result of treatment and recovery from 9/11-related illnesses. If you lose the ability to work — either temporarily or permanently — due to any possible 9/11-related illnesses, you may claim compensation for your past and future lost earnings under the rules of the VCF.
