The 9/11 Victim Compensation Fund Final Rules state that the Fund will be “open” to receive claims next Monday, October 3, 2011. However, to date, the all important 9/11 VCF application forms and claim filing instructions have not been posted on the Department of Justice website. As a result, the reality will be that few if any claims will be “filed” by claimants starting next Monday.
This is fine to the extent that Special Master Sheila Birnbaum and her staff are perfecting the claim forms, which must strike the delicate balance between being simple enough for non-represented claimant’s to complete, yet comprehensive enough so that claimants file for all the damages to which they are entitled. This is not an easy job.
I predict that the forms, along with comprehensive instructions and examples, will be released on Monday, October 3rd, and posted on the Justice Department VCF website here. Zadroga attorneys will then have a chance to digest the forms and begin the process of assembling all the information necessary for their clients to receive both the “economic damages” and “non-economic damages” they deserve.
