Many of our 9/11 Victim Compensation Fund clients have called in recent days about suing the Kingdom of Saudi Arabia in addition to filing their 9/11 Victim Compensation claim.

Let’s be clear! At this point, no 9/11 lawyer can tell you with any certainty that you have a good 9/11 Saudi Arabia case under the Justice Against Sponsors of Terrorism Act (JASTA), which was passed by Congress last week. No lawyer- no law firm – period! End of story.

Unfortunately, a number of our clients have received solicitation emails from various law firms telling them that they are already representing them in the Saudi Arabia lawsuit.

However, the 9/11 Victim Compensation regulations specifically permit  a lawsuit like the 9/11 Saudi Arabia one contemplated without any impact on a 9/11 Victim Compensation Fund claim. You should speak now to your current 9/11 Victim Compensation Fund attorney or another experienced and respectable 9/11 attorney so you can prepare to join any possible lawsuit down the road.

Unlike the administrative program of 9/11 Victim Compensation Fund, the hurdles of proving in federal court that the Kingdom Of Saudi Arabia was responsible for the 9/11 attacks are much higher.

In addition, there are significant questions on who will be able to join the lawsuit. Will it only be victims and families affected directly on 9/11? Or will 9/11 first responders and all those now eligible for benefits under the Zadroga Reauthorization Act, such as those who now have 9/11 related cancers, be allowed to sue also?

The honest answer is that no lawyer truly knows now how JASTA will play out for 9/11 victims. Will Congress revise the law after the Presidential election, as it currently being discussed? Currently, JASTA allows the federal government to intervene and postpone the lawsuit while they try to resolve the issue diplomatically. Even if victims were to win a lawsuit against the Kingdom of Saudi Arabia, would the Kingdom ever actually pay?
