Recently, we’ve written about the struggles some 9/11 first responders, recovery workers and others have had in obtaining treatment and compensation for the illnesses they acquired as a result of their brave and selfless work in the hours, days, and months after the September 11th attacks. A recent New York Post article shined a light on how EMTs and paramedics seeking disability for their 9/11-related conditions were being denied benefits at an extremely high rate. Similarly, the New York Daily News told the story of a criminal investigator who was denied disability and workers compensation benefits even though his condition was certified as 9/11-related.
Those problems remain, but a recently signed New York law should at least help responders and recovery workers with their efforts to treat their illnesses by providing them with unlimited sick leave benefits for 9/11-related illnesses and injuries.
On September 11th of this year, Gov. Andrew Cuomo signed legislation passed earlier in the year which provides line-of-duty sick leave to rescue and recovery workers with conditions related to their response to the 9/11 attacks. As such, individuals sickened or injured during rescue, recovery or cleanup at or near Ground Zero won’t have to use their regular sick leave to care for their illnesses and conditions.
Now, any sick 9/11 first responder living in the state of New York can take as many sick days as they need. Additionally, they are now eligible for sick leave at 100 percent of their regular salary dating back to the time of their diagnosis.
This new legislation is to be applauded. Any efforts which help those who are suffering because of their bravery and commitment after the 9/11 attacks should be supported. Helping 9/11 victims obtain treatment and compensation has been the exclusive mission of this law firm since shortly after the towers fell.
