On Monday, August 19th, the 9/11 Victim Compensation Fund (VCF) updated their proof documentation requirement for New York City Employees who are also members of the New York City Employees’ Retirement System (NYCERS). The VCF has partnered with NYCERS in order to obtain supporting documents that may show a New York City employee’s presence at Ground Zero.

NYCERS members may be employed by such New York City agencies as the Department of Sanitation, Department of Corrections and the Transit Authority as well as many other New York City bureaus. Contractors that were hired by New York City to perform search, recovery, clean-up and other services at Ground Zero may also be members of NYCERS.

This new partnership with NYCERS is good news as Claimants working for these New York City agencies may have been finding it difficult to obtain proof documentation. The general rule is that the VCF requires Claimants to provide two forms of proof. Such proof  may include employment records, contemporaneous medical records and witness affidavits.  However, if you were an employee of a New York City agency, a member of NYCERS AND filed a WTC-12 Notice of Participation form, you will NOT need to provide the 9/11 Victim Compensation Fund with any further documents unless it is requested after the review of your claim.

Should the 9/11 Victim Compensation Fund ask you for more proof documentation, it may temporarily delay your claim. To avoid this it is recommended that you should still get witness affidavits and submit them to the VCF along with your WTC-12 Notice of Participation even though it is not initially required. The WTC-12 is a form that was necessary to be filed with the New York State Workers’ Compensation Board by September 13, 2010 in order to preserve the right to file for disability under the World Trade Center disability law.

These new requirements do not pertain to NYPD or FDNY. However, if you were a civilian employee of these agencies, and meet the requirements stated above then you may submit your WTC-12 Notice of Participation to the VCF in order to obtain proof.  Click here for complete proof documentation requirements for the NYPD and FDNY.
