Zadroga Act September 11th Victim Compensation Fund Releases Final Compensation Claim Forms, 12/ 5/ 2011

Yesterday, September 11th Victim Compensation Fund (VCF) Special Master Sheila Birnbaum released the final forms necessary for any claimant to fully file a Zadroga Act Victim Compensation Fund Claim. The official form for claimants and/or their attorneys to file for “compensation” from the 9/11 Victim Compensation Fund can be downloaded here for your use.

Whether or not you are currently represented by counsel, any eligible claimant can officially file 9/11 VCF claims as of today. Please make sure to review the “9/11 Victim Compensation Fund Document Checklist” before filing, which can be downloaded here also.

Zadroga Act 9/11 Victim Compensation Fund Opens October 3rd for Registration Only

The new Zadroga Act 9/11 Victim Compensation Fund officially opened for business today. In a surprise move, VCF Special Master Sheila Birnbaum has establissed a three step “phased in” application process starting today. Attorneys (or claimants without representation) can immediately “register” for the 9/11 Victim Compensation Fund here. A new “Eligibility Form” will be released to the public on or about 10/28/2011. On or about November 28, 2011, the Special Master will finally release the actual “Compensation Claim Form”. Eligible claimants will be able to see a new “Document Checklist” so they or their representatives can start assembling all necessary documents to perfect the claim.

Will Zadroga 9/11 Victim Compensation Fund Application Forms be Ready on October 3rd?

The 9/11 Victim Compensation Fund Final Rules state that the Fund will be “open” to receive claims next Monday, October 3, 2011. However, to date, the all important 9/11 VCF application forms and claim filing instructions have not been posted on the Department of Justice website. Zadroga attorneys will then have a chance to digest the forms and begin the process of assembling all the information necessary for their clients to receive both the “economic damages” and “non-economic damages” they deserve.
As soon as the new 9/11 VCF forms are available, we will post them here.

Zadroga 9 11 Act Victim Compensation Fund Final Rules Published – “Crash Site” Expanded to Below Canal Street to Include Chinatown

Zadroga Act Special Master Sheila Birnbaum today issued the long awaited Zadroga Act 911 Victim Compenstion Fund Final Rules & Comments. See the Zadroga Act Final Rule Press Release here. Perhaps the most important change which resulted from the numerous comments to the draft rules was the expansion of the “crash site” to the area below Canal Street in lower Manhattan (including a good portion of Chinatown). Unfortunately, the Special Master is still excluding both cancer and PTSD from compensation coverage. At this time, I am of the opinion that their is still a 50% chance that cancer will be eventually be covered under the Zadroga Act Victim Compensation Fund.
